Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Picmori ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Picmori, operated by Aleksandrs Vozņarskis ("Operator"). We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. App Description

Picmori is a mobile application that helps users manage and clean up their photo and video libraries. The App provides the following features:

  • Photo Review: A swipe-based interface to review and decide which photos to keep or delete.
  • Duplicate Detection: AI-powered perceptual hashing to identify similar and duplicate photos on your device.
  • Clutter Detection: Automatic identification of screenshots, large videos, and other space-consuming content.
  • Session Modes: Multiple review modes including Quick, Standard, Deep Clean, Similar, Memory, and Clutter sessions.
  • Progress Tracking: Statistics, daily streaks, and achievements to track your cleanup progress.
  • Photo Sharing: Ability to share photos to third-party social apps through your device's standard sharing mechanism.
Important: All photo processing happens entirely on your device. Your photos are never uploaded to any server.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the App.

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account & Access

Picmori does not require you to create an account. The App functions entirely without user registration or login. If you purchase a premium subscription, your purchase is associated with your account through the applicable app store on your device.

5. Subscription & Payments

5.1 Free Tier

Picmori is free to download and use with the following daily limits:

  • Up to 30 photo deletions per day
  • Up to 3 review sessions per day

Daily limits reset at the beginning of each calendar day.

5.2 Picmori Premium

Picmori Premium is a paid subscription that removes all daily limits, providing unlimited deletions and unlimited review sessions. The subscription is available as a recurring plan.

5.3 Payment & Billing

  • Payments are processed through the applicable app store on your device.
  • Subscription fees are charged to your app store account upon confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your device's subscription management settings.

5.4 Refunds

Refund requests are handled by the applicable app store according to their respective refund policies. We do not process refunds directly.

5.5 Restore Purchases

If you reinstall the App or switch devices, you can restore your existing subscription through the App's Settings screen at no additional charge.

6. Acceptable Use

You agree to use the App only for its intended purpose: managing your personal photo and video library. You agree not to:

  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Modify, adapt, or create derivative works based on the App.
  • Circumvent, disable, or interfere with any security, licensing, or usage-limiting features of the App, including free-tier restrictions.
  • Use the App for any illegal, unauthorized, or harmful purpose.
  • Redistribute, sublicense, or sell the App or any part thereof.
  • Use automated systems (bots, scrapers) to interact with the App.

7. Photo Management & Deletion

Please Read Carefully: The deletion of photos and videos through the App is a permanent action that may not be reversible.

7.1 User Responsibility

You are solely responsible for all decisions to keep or delete photos and videos through the App. We strongly recommend maintaining regular backups of your important photos before using the App.

7.2 Deletion Process

The App uses a safety-first deletion workflow:

  1. During a review session, photos you swipe to delete are marked as "pending deletion".
  2. At the end of a session, you are shown a summary and asked to explicitly confirm the deletion.
  3. Only upon your confirmation does the App request your device's operating system to delete the photos.
  4. On some devices and operating systems, deleted photos may be moved to a "Recently Deleted" folder and can be recovered for a limited time.

7.3 No Guarantee of Recovery

Once you confirm deletion, we cannot guarantee that deleted photos can be recovered. The availability and duration of the "Recently Deleted" feature depends on your device's operating system and settings. Picmori is not responsible for any data loss resulting from your use of the App.

7.4 Duplicate Detection Accuracy

The duplicate and similarity detection feature uses perceptual hashing algorithms, which provide approximate matching. While generally accurate, the system may occasionally identify photos as similar when they are not (false positives) or fail to identify similar photos (false negatives). You should always review suggestions before confirming any deletions.

8. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to its design, code, graphics, animations, icons, and trademarks, are owned by Picmori and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You retain all ownership rights to your photos and videos. The App does not claim any rights over your content.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the practices described in our Privacy Policy.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
  • ANY WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF THE DUPLICATE DETECTION ALGORITHMS.
  • ANY WARRANTY THAT DELETED PHOTOS CAN BE RECOVERED.

You acknowledge that the use of the App is at your sole risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PICMORI, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of data, photos, videos, or other content, whether or not we have been advised of the possibility of such damages.
  • Any damages arising from the deletion of photos or videos, whether intentional or accidental.
  • Any damages resulting from unauthorized access to or alteration of your data.
  • Any damages exceeding the greater of: (A) the total subscription fees you paid for the App in the twelve (12) months preceding the claim, or (B) ten euros (€10).

12. Indemnification

You agree to indemnify, defend, and hold harmless Picmori and its developers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.

13. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to suspend or terminate your access to the App or any of its features at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and may notify you through the App. Your continued use of the App after any changes indicates your acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Latvia and applicable European Union regulations, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Latvia.
